They’ve labeled them all as Tren de Aragua gang members under the Alien Enemies Act, but the evidence is murky, and families are pushing back hard. Take Mervin Jose Yamarte Fernandez, for instance. He’s a 29-year-old Venezuelan who was working at a restaurant in Texas when he got nabbed. His sister, Jare, says he’s no gang member—never had a criminal record—and was actually planning to self-deport back to Venezuela later this year. She spotted him in a video of the deportees arriving at CECOT, head shaved, shackled, looking broken. She claims he was just a hard worker trying not to burden the U.S., not some cartel thug. Then there’s Jhon Chacin, a tattoo artist from Zulia, Venezuela. His brother, Eudomar, says Jhon was set to fly back home voluntarily on March 13 after his asylum claim tanked—weather delayed the flight, and instead, he ended up in El Salvador. Eudomar recognized him in a Trump admin video, chained up with the others. Jhon’s tattoos, meant to showcase his craft, might’ve been misread as gang signs, but there’s no public proof he’s Tren de Aragua. Another case: Reyes Barrios, a former pro soccer player. His lawyer says he fled Venezuela after being tortured by the regime, not because he was a criminal. He was detained at the Otay Mesa border in California under the old CBP One program, only to get shipped off to CECOT. His uncle, Jair, insists he’s innocent, just a guy seeking asylum. The catch? The Trump admin’s been tight-lipped about how they ID’d these guys as gang members. They’ve admitted many don’t have U.S. criminal records, and the process skipped hearings or trials—straight to deportation under a 1798 wartime law. Families and lawyers argue the evidence is flimsy, often just tattoos or social media posts, which experts say doesn’t hold up as proof of gang ties. The ACLU and others are suing, claiming it’s a rights violation, and a federal judge even tried to stop the flights (too late, planes were already gone). So, who shouldn’t be there?
