The litigation challenging the Trusted News Initiative (TNI) is moving into a critical stage. TrialSite Inc., Robert Kennedy Jr., Children’s Health Defense, and other plaintiffs are suing TNI, alleging they were wrongfully censored on social media platforms at the behest of TNI. The lawsuit, initially filed in Texas and then refiled in Louisiana, has now moved to the federal circuit in Washington D.C. The plaintiffs argue that the defendants, including The Associated Press, BBC, Reuters, and The Washington Post, along with other newsgroups and social media platforms, are participating in an antitrust case. The defendants are currently trying to stop the litigation via a Rule 12(b)(6) motion to dismiss. The plaintiffs hope that the judge will review the case impartially and progress the litigation forward, opening up TNI and their platform partners to discovery.
